Terms of Service

1. Acceptance of Terms

By accessing or using Marketlead (“the Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

2. Description of Service

Marketlead is an AI-assisted recruitment service that connects candidates with employers in marketing, product, sales, and adjacent fields. Our service includes:

• —AI-assisted analysis and scoring of candidate profiles against role requirements;
• —matching between candidates and relevant employer roles;
• —facilitated introductions, made only with the candidate’s consent.

Marketlead is an introductions service. It is not a public job board, labor exchange, or self-registration platform, and it does not provide a personal candidate account.

2.1 Pricing. Marketlead is currently free for candidates. Services for employer clients are provided under a separate commercial agreement. If we introduce paid features for candidates in the future, we will notify you in advance and mark them clearly; your existing free access will not be retroactively charged.

3. Eligibility and Engagement

• —The Service is not intended for anyone under 18.
• —You must provide accurate and complete information.
• —Candidates engage with us directly and voluntarily; no account registration is required or offered for candidates.
• —You are responsible for the accuracy of what you share and for any activity you conduct through our communications.

4. User Content

4.1 Your Responsibilities. When you share content (e.g., your CV, profile links, preferences), you represent that:

• —the content is accurate and truthful;
• —you have the right to share it;
• —it does not violate any law or third-party rights;
• —it contains no malware or harmful code.

4.2 License Grant. By sharing content, you grant Marketlead a non-exclusive, worldwide license to use, store, and share it solely to provide the Service — for example, to present your profile to an employer you have agreed to be introduced to.

4.3 Content Removal. You can ask us to delete your content at any time by emailing hello@marketlead.me. We will remove it from our active systems within 30 days, except where retention is required by law.

5. AI Analysis and Scoring

Important Notice: Marketlead does not make hiring decisions, and our AI does not make final decisions about candidates.

• —We use AI to speed up and assist analysis, matching, and scoring against role requirements.
• —AI scores and match suggestions are recommendations, not accept/reject decisions.
• —Employers always review candidates and make their own hiring decisions with human review.
• —Marketlead never autonomously accepts or rejects a candidate for employment.
• —Scores may not capture every aspect of your qualifications, and AI systems have limitations.

6. Prohibited Conduct

You agree NOT to:

• —provide false, misleading, or fraudulent information;
• —impersonate another person or entity;
• —upload malicious code or harmful content;
• —scrape, crawl, or automatically extract data from the Service;
• —interfere with or disrupt the Service;
• —violate any applicable law;
• —harass, abuse, or harm others;
• —use the Service for spam or unsolicited communications.

7. Intellectual Property

7.1 Our Property. Marketlead owns all rights to the Service, including software, design, trademarks, content, and matching methodology (excluding user-shared content). You may not copy, modify, or distribute our intellectual property without permission.

7.2 Your Property. You retain ownership of the content you share. We use it only as necessary to provide the Service.

8. Disclaimers

NO GUARANTEES:

• —We do not guarantee a job placement, an interview, or a hire.
• —We do not guarantee the accuracy of AI-assisted assessments.
• —We do not guarantee uninterrupted or error-free service.
• —Employers make their own hiring decisions independently.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKETLEAD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR USD 100 IF NO PAYMENT WAS MADE).

10. Indemnification

You agree to indemnify and hold harmless Marketlead from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, your shared content or use of the Service, or your violation of any law or third-party rights.

11. Third-Party Services

Our Service relies on trusted third-party providers for categories such as hosting, storage, communication, analytics, and AI processing. These providers have their own terms and privacy policies. We are not responsible for their actions. See our Privacy Policy for how these categories are used.

12. Modifications to Terms

We may update these Terms at any time. We will notify you of significant changes by a notice on the platform or by email where appropriate. Continued use after changes constitutes acceptance.

13. Termination

You may stop using the Service and request deletion of your data at any time. We may suspend or terminate access for violations of these Terms. Upon termination, your right to use the Service ceases, your data is deleted within 30 days (unless required by law), and provisions that should survive (e.g., liability, indemnification) remain in effect.

14. Governing Law and Disputes

14.1 Governing Law. These Terms are governed by the laws of the jurisdiction in which Marketlead operates, without regard to conflict-of-law principles.

14.2 Informal Resolution. Before any formal action, you agree to contact us at hello@marketlead.me and attempt to resolve the dispute informally within 30 days.

14.3 Formal Resolution. If informal resolution fails, disputes will be resolved before the competent courts of the governing jurisdiction, or through binding arbitration where the parties agree.

15. Force Majeure

Marketlead is not liable for failure or delay resulting from circumstances beyond our reasonable control, including natural disasters, war or terrorism, pandemics, government actions, power or internet outages, or third-party service outages.

16. Severability

If any provision is found invalid or unenforceable, the remaining provisions continue in full effect.
